EU compliance

I realise that theree have been other posts on this subject , BUT ,
has anyone got any recent experience of importing a non EU-built
Freedom recently. My investigations so far seem to point to having to
prepare a ‘technical file’ that proves any boat-in-question is
compliant with the Recreational Craft Directive probably involving
prohibitive investigation costs , let alone any required work to be done.

Jon,

I imported a US Freedom in the Neherlands in Februari 2006. I looked
into the RCD stuff but did not (yet?) get an EC-marking. I have a
quote for a Freedom 44 type approval. The consultant asks EUR 4500;
the main work is collecting technical documentation and translating
it in Dutch (I think translation is not a necessity, so the price is
steep, I feel). I would become owner of the type approval and
could ‘sell’ it to prospective F44 owners importing from outside the
EU.

Here in the Netherlands we don’t bother yet with the RCD. No
government body really cares anyway, at this time. Only customs and
excise wants to know if you paid your VAT.

Thanks for this Michel. I came close to buying an F40 in the UK recently but my surveyor warned me off. The price you quote doesnt seem prohibitive , my surveyor thought that 10-15000 Euros (UK prices!) would be needed to make the technical file.I write to you as a personal email as the current owner is still using this boat in the UK which apparently is illegal without a CE mark! Jon,

One thing I forgot to mention…

If you import an F40 in the EU, you will not need an RCD type
approval because the F40-type was built and used in the EU (in the
UK) before 1996 (I think that’s the crucial year). For yachts not
built and sold in the EU before that year, you would officially need
a CE-mark.

So you have no problems and there are a couple of F40’s for sale in
the US for good prices, compared to the UK. I know Simena, the F40
for sale in the UK. I would personally not go for the deep keel
version without the centreboard.

Thanks again Michel.In the UK at least the critical date was June 1998.Agreed the Freedoms were built under licence certainly by Western Yachts in Cornwall.Therefore , if the yacht was built by Westerns before 1998 , it would be RCD-exempt.The ‘grey’ area ( As with a lot , if not all EU legislation!- you remember the rule that a Carrot is classified as a fruit , because the Spanish make Jam out of them!) is if a boat of the same type , built in USA before 1998 , is imported , is the Type of this boat exempt because others had been built in the EU ? My surveying and RYA contacts seem to have many and differing views on this. I’ll forward this on to the current owner for his interest.I agree with the Centre-board argument ,

If the designer, lines and construction methods of the UK F40 are
similar to the US F40 (and you can argue that they are, because
western yachts needed a licence to be allowed to built the boat)
then I would say you are okay. The F44 was never imported or built
in the EU, so I’m in a different storybook.
